Each member of enterMarts acknowledges and accepts the terms and conditions of use of the services, which are described here below

 

 1. Common provisions


1.1 Effective date and period of validity of the terms of use
The enterMarts terms and conditions of use apply to each member as soon as that member logs onto the enterMarts service on the www.enterMarts.com website. They take precedence over previous terms and conditions and may be modified at any time by enterMarts. Such modifications become immediately effective from the moment that they are put online.
 1.2 Security
 The user member of the MyenterMarts service and other associated services declares that they are aware of these risks and assume them. In no case whatsoever may enterMarts be held liable for any direct or indirect prejudice and/or harm incurred due to any interruption, malfunction, suspension, and/or end of the MyenterMarts service.
enterMarts is unable to offer any absolute guarantee of security, insofar as Internet is an open network that is, by its very nature, sensitive to such risks.


2. MyenterMarts


2.1 Operation
MyenterMarts is a service on the www.enterMarts.com website that centralizes all the bespoke services and profile information of each member subscribing to the site.
MyenterMarts enables each member to access all the information and functions of their assigned website, to make any modifications, and to publish information directly on the enterMarts website.
Some options may lead to supplementary costs, which will then be invoiced by enterMarts to the member.
Modifications are published on the website within 2 working days commencing their validation by each member.
Each member guarantees that the information provided to enterMarts is exact and up-to-date when subscribing. Nevertheless, enterMarts may not be held liable for any inaccurate or out-of-date information forwarded by a member, including translations supplied by the member.
Each member undertakes to refrain from impeding the correct functioning of MyenterMarts  in any way whatsoever, and shall especially ensure that they do not excessively overload the bandwidth and/or transmit elements that may damage, intercept and/or interfere with all or part of the enterMarts website.
enterMarts and you are independent contractors, and no agency, partnership, joint venture, employee-employer or franchiser-franchisee relationship is intended or created by the Terms.
2.2 User identifier and passwords
In order to access the My enterMarts services, each member must enter a user identifier (their contact e-mail) and the password attributed by enterMarts. The user may then make modifications to it and choose a new password.
Should the new password be forgotten, each member may request that their original password be sent again.
Each member undertakes to keep any user identifier and chosen password strictly confidential.
enterMarts may not be held liable in any way whatsoever should the user identifier and password be used by a third party.


3.  Intellectual property rights


enterMarts and its logo are registered trademarks. They are the exclusive property of enterMarts. Any editorial elements and contents of the www.enterMarts.com website (especially trademarks, texts, graphics, logos, animations, etc.) are the exclusive property of enterMarts, except for elements contributed by enterMarts partners and others. All rights of reproduction and representation of the www.enterMarts.com website are reserved for all countries and for all media, present and/or future.
With regard to the databases that make up the www.enterMarts.com website, each member accepts and acknowledges that the data recorded therein is legally protected and, pursuant to the above-mentioned law, each member shall refrain from:
•    extracting, using, storing, reproducing, representing or recording, directly or indirectly in any medium whatsoever and by any means whatsoever and in any form whatsoever, all or a qualitatively or quantitatively substantial part of its contents;
•    Any attempt of fraudulent extraction may constitute an act of copyright infringement.
The same is true for enterMarts nomenclature and taxonomy to which members will have access.
Each member retains ownership of the rights that they hold over contents submitted, displayed, or published on MyenterMarts and/or the www.enterMarts.com website. Nevertheless, each member grants enterMarts a free license for the non-exclusive right to reproduce, adapt, modify, translate, publish, represent, and display the said contents worldwide.
enterMarts may have independent third parties involved in the provision of the Services (e.g., the Trust ID service providers).  You may not use any trademark, service mark, or logo of such independent third parties without prior written approval from such parties.


4. Contents and Interruption to MyenterMarts access


enterMarts hereby reminds members that they are strictly forbidden from putting on-line through the MyenterMarts website any contents that are protected by intellectual property rights without the prior and formal authorization of the concerned right-holders. Failure to observe this condition may result in the member incurring sanctions laid down by law.
Information transmitted by the members may contain hyperlinks to other sites. enterMarts is unable to monitor these external sites and therefore may not be held liable for the availability and/or contents of these hyperlinks.
Each member is responsible for the contents that they publish through MyenterMarts on the enterMarts website. Such As, the member undertakes not to publish or put on-line any contents (images, videos, texts, etc.) that might cause harm, a breach of the peace, and/or a breach of moral standards.
enterMarts may, at any moment, suspend access to MyenterMarts and/or all of the www.enterMarts.com websites of any member who has breached these terms of use and, more generally speaking, any applicable legislation and/or regulation, and may do so without incurring any liability and without prejudice to any other rights or resource. In this event, no reimbursement, even partial, shall be made by MyenterMarts if the member has taken out a paying subscription.


5. General provisions


5.1 Attribution of jurisdiction
As a condition of your access to and use of the Sites or Services, you agree that you will comply with all applicable laws and regulations when using the Sites or Services.
In the event of any major difficulty or dispute arising between a service member and enterMarts, the parties agree to seek an amicable settlement. Should this fail, the dispute shall be brought before the Commercial Court in Nanterre. These terms and conditions of use are governed by law. The English version shall prevail over any translation of these terms and conditions that may have been written.
Services (or any features within the Services) may vary for different regions and countries. No warranty or representation is given that a particular Service or feature or function thereof, or the same type and extent of the Service or features and functions thereof will be available for Users. enterMarts may in our sole discretion limit, deny, or create different levels of access to and use of any Services (or any features within the Services) with respect to different Users.
5.2 Equipment and connection charges
It is the user’s responsibility to install the appropriate equipment in order to be able to connect to MyenterMarts.
All costs relating to equipment, connection, and transmission arising from the use of MyenterMarts shall be borne exclusively by the user. Moreover, the user shall take all appropriate measures to protect their own data and/or software stored on their computer equipment from any loss or damage. The user is wholly liable for the connection.
